iFamily Terms of Use and Liability Waiver

Governing Law: State of Delaware, United States

By creating an account, accessing, or using the iFamily mobile application, you agree to these Terms of Use and Liability Waiver. If you do not agree, you may not use the App.

Eligibility and Age Verification

  • You must be 18 years or older to use iFamily.
  • We may request government-issued identification at any time to verify your age and reserve the right to suspend or terminate any account suspected of being underage or providing false information.
  • If a minor misrepresents their age, their parent or guardian agrees to release iFamily from any liability arising from their use of the App.
  • By using the App, you confirm you have the legal capacity to enter this agreement.

2. No Background Checks / No Guarantee of Safety

iFamily does not conduct criminal background checks, identity verification, or screening of users. We do not:

  • Guarantee the identity, intentions, safety, or behavior of any user.
  • Confirm the accuracy of information provided by users.
  • Control user actions, on or off the platform.

By using iFamily, you acknowledge that interactions with others, whether online or offline, are at your own risk. You release iFamily from any claims or liabilities arising from fraud, scams, abuse, harm, or unlawful actions by other users.

3. Third-Party Meetings at Own Risk

iFamily provides an online platform only. We do not arrange or monitor in-person meetings, and we cannot guarantee your safety if you choose to meet someone offline.

You accept full responsibility for your personal safety during any such meetings. We strongly recommend:

  • Meeting in public places.
  • Notifying friends or family of your plans.
  • Using extreme caution.

We are not liable for any incidents, harm, injuries, or crimes that occur during or as a result of offline meetings.

4. No Guarantee of Matches or Emotional Outcomes

We make no promises that:

  • You will find matches, friendships, or relationships on iFamily.
  • You will experience any particular emotional benefit or outcome from using the App.
  • Your experience will meet your expectations.

You agree that iFamily is not responsible for emotional distress, dissatisfaction, or claims of “false advertising” relating to user interactions or outcomes.

5. Limitation of Liability for Severe Incidents

To the maximum extent permitted by law, you agree that iFamily and its affiliates shall not be liable for:

  • Death, personal injury, sexual assault, kidnapping, or other acts of violence, whether occurring online or offline.
  • Emotional distress, financial loss, property damage, or other harm caused by other users.

You assume all known and unknown risks associated with meeting or communicating with others through the App.

6. Emergency Response Disclaimer

iFamily is not an emergency or crisis service. We cannot:

  • Dispatch law enforcement or emergency responders.
  • Provide real-time assistance in dangerous situations.

If you feel unsafe or are in immediate danger, you must contact local law enforcement or emergency services immediately.

7. User Content and Third-Party Liability

  • You are solely responsible for any content you post, share, or send via iFamily.
  • iFamily does not control or endorse user-generated content and is not liable for:
    • Statements, messages, or actions of other users.
    • Harmful, offensive, illegal, or inappropriate content shared in chats or profiles.

We are not responsible for any loss, damage, or harm caused by third-party content or conduct.

8. No Duty to Monitor

iFamily is not obligated to actively monitor user activity, messages, or behavior, and we make no guarantees that harmful, illegal, or unsafe content or conduct will be detected or prevented.

You agree that we are not liable for failing to act on potential risks or harmful activity.

9. Account Suspension and Termination

  • We reserve the right to suspend, restrict, or permanently terminate your account at our discretion, without prior notice, for:
    • Violations of these Terms or Community Guidelines.
    • Harmful, illegal, or unsafe behavior.
    • False or misleading information provided during registration.
  • Terminated users are not entitled to refunds for paid services unless required by law.

10. No Warranty of Uptime or Uninterrupted Service

We do not guarantee:

  • That the App will be available without interruption or error.
  • That servers will be free from bugs, delays, or technical issues.
  • That messages or connections will be delivered reliably.

You agree iFamily is not liable for downtime, technical failures, or service interruptions, including any loss of data or messages.

11. Data Security and Breach Disclaimer

While we take reasonable measures to protect user data, no system is completely secure, and breaches may occur despite safeguards.

iFamily is not liable for unauthorized access, hacking, or data loss caused by third parties beyond our control.

12. Refund Policy for Paid Services

All in-app purchases and subscriptions are non-refundable, except where required by applicable law or at our discretion.

Users are responsible for canceling subscriptions before renewal periods to avoid future charges.

13. Geographic Restrictions and Local Laws

You are responsible for ensuring that use of iFamily complies with local laws in your country or region.

We are not liable for consequences if you use the App in locations where such services are restricted or illegal.

14. No Medical or Mental Health Advice

iFamily is a social connection platform, not a professional counseling or medical service.

  • Any advice, messages, or support from users or the app should not be considered medical, psychological, or crisis advice.
  • If you need professional help, you must seek licensed healthcare providers or emergency hotlines.

15. Intellectual Property Rights

All iFamily content, trademarks, logos, and software are the exclusive property of iFamily Co, also registered previously as Hit2b Co.

Users may not copy, reproduce, distribute, or use our content or technology without prior written permission.

16. Force Majeure

We are not liable for delays or failure to perform our obligations due to events outside our control, including but not limited to natural disasters, server outages, cyberattacks, government actions, or network failures.

17. Binding Arbitration and Class Action Waiver

You agree that:

  • All disputes between you and iFamily will be resolved exclusively through binding arbitration under the rules of the American Arbitration Association in Delaware, United States.
  • You waive any right to participate in class actions, collective lawsuits, or jury trials against iFamily or its affiliates.

18. Jurisdiction and Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Any claims not subject to arbitration must be filed in the state or federal courts located in Delaware.

19. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied. We do not guarantee:

  • Uninterrupted, error-free service.
  • Accuracy or reliability of any content or matches.
  • Compatibility, safety, or successful connections with other users.

20. Exclusion of Indirect or Punitive Damages

To the maximum extent permitted by law, iFamily shall not be liable for indirect, incidental, consequential, punitive, or exemplary damages, even if advised of their possibility.

21. Release of Claims

By using iFamily, you release iFamily Co, also registered previously as Hit2b Co, its owners, employees, affiliates, and partners from all claims, demands, damages, or liabilities arising from:

  • Your interactions with other users.
  • Any harm, injury, or loss resulting from online or offline activity linked to the App.

22. Indemnification

You agree to indemnify and hold harmless iFamily Co and its affiliates against any claims, damages, or expenses (including attorney fees) arising from:

  • Your violation of these Terms.
  • Your interactions with other users.
  • Any third-party claims related to your conduct or content on the App.
  • You further agree to indemnify iFamily Co for any legal costs or damages arising from claims made by other users or third parties due to your actions or content on the App.

23. Survival of Key Clauses

The provisions relating to liability limitations, waivers, arbitration, indemnification, intellectual property, and governing law shall survive termination of this Agreement or closure of your account, remaining enforceable indefinitely.

24. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

25. Limitation of Liability Cap

In no event shall iFamily Co’s total liability to you exceed the amount you paid (if any) to use the App in the preceding 12 months.

26. Modifications

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the updated Terms.

  • You are 18 years or older.
  • You have read and understood these Terms, including all liability waivers, arbitration requirements, safety disclaimers, damages limitations, indemnification, and survival clauses.
  • You accept full responsibility for your actions and safety while using iFamily.
